Not allowing the LAD police officers to ask for proof of citizenship is just another example of an organization caving to the PC goon squad. Maybe Sheriff Joe from Maricopa County should be the next LAPD's police chief? Identifying and deporting illegal aliens saves lives, money, and sends a message that America is a civil nation of laws, and law breakers will be arrested.

Althea Shaw, Jamiel's aunt who is pushing for a new law requiring police to check known gang members' immigration status upon arrest, said she was disappointed by Beck's decision.

LOS ANGELES -- Immigration agents have arrested 280 people in California in a huge sweep aimed at rounding up suspected illegal immigrants with criminal records.

Immigration and Customs Enforcement says more than 400 agents and local law enforcement officers fanned out across the state in a three-day search for immigrants with criminal histories who lack the right to remain in the United States.

In addition to the 280 with criminal records, ICE officials say another six people who are under deportation orders were also arrested.

Nelson’s amendment would prohibit federal funds from paying for any part of any health insurance plan that covers abortion.

“The men who have brought us this [amendment] don’t single out a procedure that is used by a man, or a drug that is used by a man, that involves his reproductive health care, and say they have to get a special rider,” Boxer said. “There is nothing in this amendment that says if a man some day wants to buy Viagra, for example, that his pharmaceutical coverage cannot cover it, that he has to buy a rider.”

The human dung pile that murdered four police officers while they were having coffee, had been released by then gubner Huckabee of Arkansas. Probably was pandering for votes. And just another fact, this scrub was being held, but made bail, on second degree rape of a child. If not for political correctness, and Schmuckabee, 4 officers would still be going home alive to their families and friends.

Nine years ago, then-Arkansas Governor Mike Huckabee granted clemency to Clemmons, commuting his lengthy prison sentence over the protestations of prosecutors.

“This is the day I’ve been dreading for a long time,” Larry Jegley, prosecuting attorney for Arkansas’ Pulaski County said Sunday night when informed that Clemmons was being sought in connection to the killings.

Clemmons’ criminal history includes at least five felony convictions in Arkansas and at least eight felony charges in Washington. The record also stands out for the number of times he has been released from custody despite questions about the danger he posed.

Clemmons had been in jail in Pierce County for the past several months on a pending charge of second-degree rape of a child.

He was released from custody just six days ago, even though he was wanted on a fugitive warrant out of Arkansas and was staring at eight felony charges in all out of Washington state.

Maurice Clemmons, the suspect wanted in the slaying of four Lakewood police officers, was shot and killed in South Seattle early this morning by a Seattle police officer making a routine check of a stolen car.

The shooting occurred about the same time as Pierce County sheriff's detectives took into custody a man believed to have acted as a getaway driver in Sunday's slayings of the Lakewood officers.

Police also booked three people into jail on suspicion of providing assistance to Clemmons, said sheriff's spokesman Ed Troyer.

There is a common thread to all of these news stories, regardless of those involved. Whether victim or person, whether protester or protested, whether born or unborn, all discussion of abortion revolves around the implication, the begged question and conclusion, that an unborn baby is a baby. No matter how we try to distance ourselves from this simple fact, using medical technology to push further and further out the timeline along which we may choose to circumvent the inevitable process of that person's being, there is no changing it. Abortion is the application of technology to a woman's body for the explicit purpose of preventing a human being from existing – a human being who, if left well enough alone, would by all rights and in all probability be born. This birth isn't merely a possibility and is not a choice; it's a biological fact, unless a natural miscarriage occurs.

Could any parent who is not a monster look at his or her newborn baby and wish it dead – wish it pre-empted, circumvented, prevented from being? Can any woman who is human willingly abdicate the title "mother" without also abdicating her own personhood, at least morally? Can any man truly claim he is a man at all if he is willing to allow innocent human life to come to harm? Can any individual who has watched a baby move its arms and shift its body on a sonographer's screen honestly believe that ending that unborn baby's existence is anything but a violent murder?

As a conservative-leaning libertarian, I don't want the government to control health care. I don't particularly want the government involved in decisions regarding abortion, either. The law regarding abortion, however, is quite irrelevant. The biological fact of abortion is that any abortion ends a human life. It snuffs it out. It assassinates it. Support legal abortion or don't, according to whatever rationalizations you employ, per whatever technological barriers you choose to erect between yourself and the admission of what you are condoning. Just don't try to tell any reasoning American citizen that abortion is anything but killing a baby.

Bower in Chief

So far it's a memorable trip. He established a new precedent for how American presidents should pay obeisance to kings, emperors, monarchs, sovereigns and assorted other authentic man-made masters of the universe. He stopped just this side of the full grovel to the emperor of Japan, risking a painful genuflection if his forehead had hit the floor with a nasty bump, which it almost did. No president before him so abused custom, traditions, protocol (and the country he represents). Several Internet sites published a rogue's gallery showing how other national leaders - the prime ministers of Israel, India, Slovenia, South Korea, Russia and Dick Cheney among them - have greeted Emperor Akihito with a friendly handshake and an ever-so-slight but respectful nod (and sometimes not even that).
Now we know why Mr. Obama stunned everyone with an earlier similar bow to King Abdullah of Saudi Arabia, only the bow to the Japanese emperor was far more flamboyant, a sign of a really deep sense of inferiority. He was only practicing his bow in Riyadh. Sometimes rituals are learned with difficulty. It took Bill Clinton months to learn how to return a military salute worthy of a commander in chief; like any draft dodger, he kept poking a thumb in his eye until he finally got it. Mr. Obama, on the other hand, seems right at home now giving a wow of a bow. This is not the way an American president impresses evildoers that he's strong, tough and decisive, that America is not to be trifled with.

Here in Stanislaus County, we have access to our local court's public records. It allows for a person to type in a name, and see if there are any current or past criminal charges or convictions. There are also a few other places on the web that allows for a bit of detective work...One is wwwzabbasearch.com Type in a persons name or phone number and their address and phone number may appear. Yahoo people search is another easy site. Again, typing in either names, addresses, or phone numbers will quickly, in most cases, lead to the info you are looking for. Google Maps allows for actual photos of individual houses, and businesses to be seen. This is a great resource for those who want to know who is a felon, or child molester, living nearby. The local probation department offers a tip line for those concerned citizens that want to pass on information of those who are on probation that are involved in on going criminal activity.
It is very important to be aware of those who live in your neighborhood. Who knows, you may help bust an illegal pot growing operation or meth lab.

A prominent Columbia architecture professor punched a female university employee in the face at a Harlem bar during a heated argument about race relations, cops said yesterday.
Police busted Lionel McIntyre, 59, for assault yesterday after his bruised victim, Camille Davis, filed charges.
McIntyre and Davis, who works as a production manager in the school's theater department, are both regulars at Toast, a popular university bar on Broadway and 125th Street, sources said.
The professor, who is black, had been engaged in a fiery discussion about "white privilege" with Davis, who is white, and another male regular, who is also white, Friday night at 10:30 when fists started flying, patrons said.
McIntyre, who is known as "Mac" at the bar, shoved Davis, and when the other patron and a bar employee tried to break it up, the prof slugged Davis in the face, witnesses said.
"The punch was so loud, the kitchen workers in the back heard it over all the noise," bar back Richie Velez, 28, told The Post. "I was on my way over when he punched Camille and she fell on top of me."
The other patron involved in the dispute said McIntyre then took a swing at him after he yelled, "You don't hit a woman!"
"He knocked the glasses right off my face," said the man, who would only give his first name as "Shannon." "The punch came out of nowhere. Mac was talking to us about white privilege and what I was doing about it -- apparently I wasn't doing enough."

A "hate crimes" bill opponents claim will be used to crack down on Christian speech, even the reading of the Bible, was signed into law today by President Obama.
The Senate approved the Matthew Shepard and James Byrd, Jr. Hate Crimes Prevention Act by a vote of 68-29 on Oct. 22 after Democrats strategically attached it to a "must-pass" $680 billion defense appropriations plan.
Most Republicans, although normally strong supporters of the U.S. military, opposed the bill because it hands out federal money to states and local governments in pursuit of "preventing" hate crimes. The bill creates federal protections and privileges for homosexuals and other alternative lifestyles but denies those protections to other groups of citizens.
American Family Association President Tim Wildmon warned that the new law "creates a kind of caste system in law enforcement, where the perverse thing is that people who engage in non-normative sexual behavior will have more legal protection than heterosexuals. This kind of inequality before the law is simply un-American."
Wildmon said the legislation creates possible situations where pastors may be arrested if their sermons on sexuality can be linked in even the remotest way to acts of violence.
"It threatens free speech and freedom of religion and is totally unacceptable," he said.
As WND reported, U.S. Attorney General Eric Holder admitted a homosexual activist who is attacked following a Christian minister's sermon about homosexuality would be protected by the proposed federal law, but a minister attacked by a homosexual wouldn't be.

POLICE FIND MARIJUANA OPERATION: A strong odor led narcotics investigators to northeast Modesto home where they discovered a large indoor marijuana growing operation that had produced about $160,000 worth of dope, Modesto police reported Thursday. Police arrested Emerson Drake, 55, at the home on the 3200 block of Canopy Court. He was booked on suspicion of cultivation of marijuana, possession of marijuana for sales and theft of electricity, Lt. Chris Fuzie said. The Modesto police Narcotics Enforcement Team and the Stanislaus Drug Enforcement Agency received information about the strong marijuana odor in the area of Kee Lane and Canopy Court, just east of Roselle Avenue and south of Sylvan Avenue. Fuzie said the investigators checked and could smell the odor for about two blocks in all directions. Police served a search warrant Tuesday with assistance from the Stanislaus County sheriff's Special Team Investigating Narcotics and Gangs. Fuzie said the investigators found the marijuana growing in three bedrooms that contained 97 budding plants with an estimated street value of $100,000 along with about 18 pounds of packaged pot with an estimated street value of $60,000. He said authorities seized the marijuana and the growing equipment worth approximately $20,000. The rental property had been converted into a growing operation. Fuzie said the house contained little more than a bed. The property owner told police he had no idea what was going on in the house and said a property management company was renting the house for him, Fuzie said.

Would You Want George Maudlin Representing You In A Real Estate Deal?

George Maudlin is willing to break the simplest of rules, such as a ban from blogging at The Modesto Bee's The Hive. So what would he be willing to do if there were a lot of money on the line for him? A simple google search of Modesto real estate companies will lead you to his broker. I am sure the broker is a good, honest business man. But does he realize what George Maudlin could possibly do to his business. On top of that, George has close ties to a local politician, and the politico's staff member who rabidly attack local real estate brokers. I wonder if that would concern George's broker? A Great Week

Nothing better to receive a punishment for doing what is right. Emerson Drake; public speaker and writer at The Hive, was outed for the con man that he is. And Robert Stanford, is just as much of a fraud, and danger to Modesto residents as Mr. Drake. Though I doubt Stanford was preparing to distribute weed Like Emerson Drake. Then the fact that Emerson was also charged with power theft from MID.

I understand why Dan Day, from The Modesto Bee, suspended me, and a few others from The Hive. He wants to keep things calm and quiet in order to bring NewBees to The Hive. It is good for business, thus good for The Bee. I will blame Emerson Drake and Robert Stanford for the continued lies and attacks on good, hard working people and businesses. They needed to be called out on it, and they were, and they went into lie and deny mode. I have received nearly 75 e-mails from Modesto City residents saying thanks for the heads up about these two. I figure that if each one tells 10 people they know, Robert and Emerson will receive single digit vote counts and will never be elected to the city council. Reconciliation always possible. I pray for that, but only God knows. Honestly at this point, I can take it either way. My life is good, pretty complete and will go on. Hive has not helped, only made things worse and LSK sticking her nose in private matters has worsened the situation. She knows that and could care less. That I know for sure and have been hurt greatly by LSK's obsessive bashing into almost every aspect of my life. Very disappointed in your behavior LSK, not only as a 12 step person, but a Christian as well.
Anyway, perhaps we can meet for coffee at Five Points soon. I work all day but with some shuffling on certain days would like to meet.

Looks like asking public figures to be accountable for their actions is not allowed in some forums, so I am on a timeout from The Bosses at The Bee's Hive. Probably do to the fact that a local supporter, and staff member, of wannabe politician Roberts Stanford, Emerson Drake, was arrested for growing,with intent to sell, marijuana, he was also accused of stealing power from MID. So when this bright light of truth was uncovered, Mr. Drake, aka truthseekers went into hiding for a few days until Robert and he came up with a plan to deal with it. And, with out fail Emerson denies the whole issue saying that the police lied, the Modesto Bee lied, and he never stole from MID. And now he continues to attack the ones who were involved in his arrest and conviction. So those who support Robert Stanford for Modesto City council, you are supporting a person who condones Emerson Drakes criminal record.....And Robert Stanford is still the man who says that Stanislaus county Sheriff officers are "murderers."

Many Illegals Are Self Deporting

I wouild ask two questions? Is the word immigrant being used in place of "illegal" and who cares what the color or racial make up is of the local population is as long as everyone is a legal resident? Of course the vast majority are illegals. Why I am asking these questions that most writers will not, "How many of the "immigrants" are fluent in English? Speaking and writing English is imporatnt for doing well in school and life here in America. There is an upside to "immigrants" leaving the area, less stress on social services the illegals are not entitled to thus spending less of my tax dollar. Test scores in school going up, less need for bi-lingual support and classes, heck, less traffic and crime. Sounds like a win win win situation. Let's hope the trend continues with "immigrants."
I am all for legal immigration as long as the numbers are regulated and background checks are done. As for the illegal immigrants? They can't self deport fast enough! And thanks for trashing our nation.

I can tell you from personal experience he is a liar. I spoke with him, in person, a few years back and he was polite, and well spoken, and we had a good conversation. No name calling or anything mean spirited. Of course that has changed since he is a Jekyll and Hyde character. Greeed, Special Interests, Developers and Two City Council Candidates...

Well it's quickly becoming politics as usual in Modesto. Two candidates that have heavily financed campaigns due to developers, Real Estate groups who are salavating at the prospect and certain "business" groups who would ask the taxpayers and ratepayers of Modesto to finance their dreams of averice.
Joe Muratore and Kristin Olsen represent special interest groups and not the people of Modesto.
One shining example is Measure "M" which is an advisory question regarding five areas in North Modesto they want us to annex. Now if we do, it's a certainity that water and sewer rates will rise in order to lay the ground work for their greed. I ask you, is that what we want? Can you afford to take money out of the mouths of your family and give it to some of the same developers who brought us the Village I debacle?
It's bad enough that "M" is an advisory vote which means the City Council can damn well do what ever it feels like it regardless of the vote.
That's why we need to take a serious look at what the candidates really stand for and not just their claims.
Is Olsen an independent voice? Not by her actions or her connections and not by the money she's collected so far. The very same can be said about Joe Muratore. Much of their money flows from the same spigot. How do you think they collected the sums they have so far?
Of the seven people running for City Council in Modesto these two(Muratore and Olsen)are most closely linked to people who are concerned about lining their pockets with money they will take from us. Yes us the taxpayers, the rate payers...the Citizens of Modesto.

Another Person Causes Their Own Demise

Looks like another guy who refused to follow LE officers directions and began to fight with them has died from his unruly behavior. It is very simple, follow directions, wait for your day in court. Tasers have saved more lives than they have taken. Many cases, if it were not for a taser, LE officers would have used their firearms, and rightfuly so. So don't buy into the the deceitful words of some who dislike all LE officers, tasers have saved many LE officers lives, and have allowed them to return home to their families after doing a job that most people would not.

This is the third time in five months an inmate has died while in custody after law enforcement officials used Tasers to subdue the men...
On Wednesday, the deputies were trying to move Ham to a cell for his safety because he had "exhibited irrational behavior and was combative," according to the news release. Ham stood 5 feet 9 inches tall and weighed 200 pounds.

VAN Jones resigned as White House green-jobs czar after the public got a look at his history of radical activism, including his time building the so-called Apollo Alliance -- a coalition of left-wing interest groups unified around the green-jobs concept. But another, even more radical Jones (not related) is leading Apollo's New York state activities.
Jeff Jones was a domestic terrorist in the late '60s and a fugitive from justice throughout the '70s -- yet now he's a leader of an influential, taxpayer-funded group.
Jones was a fugitive from justice for 11 years. His own account at his Web site says: "As a leader of the Weather Underground, Jeff evaded an intense FBI manhunt for more than a decade. In 1981, they finally got him. Twenty special agents battered down the door of the Bronx apartment where he was living with his wife and four-year-old son."
With Mark Rudd and Bill Ayers, Jones in 1969 co-founded the radical Weatherman, which orchestrated the violent "Days of Rage" riots in Chicago, and later undertook an anti-government bombing campaign. Three of its members died when a bomb they were constructing to attack Fort Dix accidentally detonated in Greenwich Village.
And Jones is still proud of his terrorist activities -- saying as recently as 2004: "To this day, we still, lots of us, including me, still think it was the right thing to try to do."
Now, Jones is back to revolutionary organizing -- but with taxpayers footing the bill. He's the director of the Apollo Alliance's New York affiliate and a consultant to the national group.
Apollo unifies the three most powerful elements of the political left -- environmental groups, labor unions and street organizers like ACORN -- and points them toward a common goal that enriches all of them under the banner of "green jobs." (Van Jones was an Apollo board member until he joined the White House staff.)
Senate Majority Leader Harry Reid recently credited Apollo with helping write the stimulus bill and getting it passed. Yet the stimulus' "green jobs" provisions funnel federal tax dollars to unions, green groups and community organizers -- that is, the organizations that make up Apollo.
Green jobs serve a political purpose, but not an economic one. The evidence from Spain and elsewhere is ample -- each green job created destroys more than two other jobs elsewhere in the economy.
Jeff Jones counts among his consulting clients (along with Apollo) a half-dozen state and local environmental groups and the Workforce Development Institute (WDI), a union-controlled organization ("developed in partnership with the NYS AFL-CIO," it says) that works with state and local government and universities.
WDI's mission is to support union influence on state and local governments. It gets state tax dollars to do it -- to the tune of $4.8 million in this year's Education, Labor and Family Assistance budget bill.
WDI is so tightly integrated with Apollo that it features a full page of Apollo information on its Web site (wdiny.org), which appears to be the primary Web presence of Apollo's New York branch. WDI encourages its members and program participants to attend Apollo Alliance events.
As a consultant to WDI, Jones is helping write the grant proposals for federal stimulus funds -- funds authorized in the bill Apollo helped write, presumably ensuring that taxpayer dollars end up in the hands of groups that share Apollo's political agenda.
Anyone should be entitled to spend his or her own money on political organizing, but Apollo and WDI are spending taxpayer dollars to organize a coalition of extreme environmentalists, labor unions and social-justice street organizers.
That's bad enough in itself, but to have the effort spearheaded by an unrepentant domestic terrorist is a true outrage.

Harvard Law School professor Cass R. Sunstein, the president's embattled nominee to head the Office of Information and Regulatory Affairs, misfired one time too many.
Mr. Sunstein has been assuring Second Amendment advocates, including key Republican Sen. Saxby Chambliss of Georgia, that he strongly believes the Constitution protects an individual right to bear arms. In a July 14 letter clarifying his positions at the request of the senator, Mr. Sunstein wrote: "Your first question involved the Second Amendment. I strongly believe that the Second Amendment creates an individual right to possess and use guns for purposes of both hunting and self-defense. I agree with the Supreme Court's decision in the Heller case, clearly recognizing the individual right to have guns for hunting and self-defense. If confirmed, I would respect the Second Amendment and the individual right that it recognizes."
There's no wiggle room in that statement, and Mr. Chambliss dropped his hold on the nomination based on Mr. Sunstein's assurances. But it turns out that the professor has held a certain contempt for the very viewpoint he suddenly claims to espouse.
A videotape has surfaced of a lecture Mr. Sunstein gave at the University of Chicago on Oct. 23, 2007. Here is what he said: "My coming view is that the individual right to bear arms reflects the success of an extremely aggressive and resourceful social movement and has much less to do with good standard legal arguments than [it] appears." Discussing the anti-gun laws in the District of Columbia, he said a critic of such strict gun control would say that a "trigger lock interferes with his efforts at self-defense against criminals. What on Earth does that have to do with the Second Amendment as originally understood?"
Later in the lecture, Mr. Sunstein said, "My tentative suggestion is that the individual right to have guns as it's being conceptualized now is best taken as a contemporary creation and a reflection of current fears - not a reading of civic-centered founding debates."
Mr. Sunstein's overt hostility to the idea that the Constitution protects an individual right to bear arms, including for purposes of self-defense, is not something that should be welcomed from somebody whose job might entail weighing in on the value of anti-gun regulations. It also makes his more recent assurances that he is a Second Amendment stalwart seem rather disingenuous, at the very least.

Modesto Tea Party, What the Bee Didn’t Show You
The conservative wing of the Republican Party threw a tea party at noon on August 14, at 1010 10th St. in the Plaza. Attending, along with at least one out of town minister, were local DJ Dave Diamond, George Petralakis (who is the political money dispenser and door man for the developers and Mike Zagaris), and Joan Clendenin, Vice-Chair of the Republican party along with about 150 of their friends.

Although most of the exchanges between the two groups were spirited, I was dismayed by something I saw on the teabaggers side. It was a sign being carried by a local and before it’s suggested, it wasn’t an ACORN plant. The sign was cheered by the rowdy throng of “baggers.” President Obama in white face and a swastika were prominently displayed.

Common Sense To Solve The USA's Debt

Lets start with the doing away with the current tax system and replacing it with a national tax. Next, close down social security, medicare and medicade. Return the money paid in to these programs to the people. Sure beats giving billions and trillions to these unconstitutional waste programs. Same with Fanny, Freddie, and any other program where the federal government is acting out of its role. Then, bring home all the troops world wide that are not in Iraq or Afghanistan. Then, extract 3 trillion dollars worth of oil from Iraq to cover their "freedom" tab. Lastly, place the troops that are brought home on both borders and at all ports of entry and international airports to inspect all non American citizens and non American shipments.
We have allowed too much of our personal duites to be given/taken over to the government, who use these programs to collect power and money, thus enslaving the American people.

The leftist media in this country has erupted in tributes to Ted Kennedy. Democrats praise him. Republicans praise him. Liberals praise him, conservatives praise him. And while we mourn when a man dies, does that mean that all criticism must stop? Does a man who spent his entire political life destroying the fundamental tenets of American morality become miraculously rehabilitated on his passing? Do conservatives stop being conservatives when such a man dies?
No! And yet it seems that the Republicans in Congress have forgotten what Ted Kennedy did to our borders. Too many so-called conservative commentators have forgotten what Ted Kennedy did to our language. Too many fawning media lackeys have forgotten that Ted Kennedy succeeded in nearly destroying our culture.
We cannot forget that he opened the borders as early as 1965. We cannot forget that he voted to destroy the flag and destroy traditional marriage. We cannot forget in spite of his death, that he voted for late-term abortion – i.e., infanticide. We can't forget that…
He voted no on a constitutional ban on flag desecration.
He voted no on a constitutional ban of same-sex marriage.
He voted yes on adding sexual orientation to the definition of hate crimes.
He voted no on banning affirmative action hiring with federal funds.
He voted yes on allowing illegals to participate in Social Security.
We cannot forget what he has done to our country.
And so now the Soros-run media sets on anyone who dares disclose the truth about Ted Kennedy. As in a Soviet show trial, persecution falls on anyone who refuses to take the party line that the great lying lion of the left must be praised. We will not be silenced. Silence is death. 16 (a) MEDICARE.— 17 (1) IN GENERAL.—Section 1861 of the Social 18 Security Act (42 U.S.C. 1 395x) is amended—
4 “(E) An explanation by the practitioner of the 5 continuum of end-of-life services and supports avail- 6 able, including palliative care and hospice, and bene 7 fits for such services and supports that are available 8 under this title. 9 “(F) (i) Subject to clause (ii), an explanation of 10 orders regarding life sustaining treatment or similar 11 orders, which shall include— 12 “(I) the reasons why the development of 13 such an order is beneficial to the individual and 14 the individual’s family and the reasons why 15 such an order should be updated periodically as 16 the health of the individual changes; 17 “(II) the information needed for an indi 18 vidual or legal surrogate to make informed deci 19 sions regarding the completion of such an 20 order; and 21 “(III) the identification of resources that 22 an individual may use to determine the require- 23 ments of the State in which such individual re- 24 sides so that the treatment wishes of that indi 25 vidual will be carried out if the individual is un 1 able to communicate those wishes, including re- 2 quirements regarding the designation of a sur 3 rogate decisionmaker (also known as a health 4 care proxy). 5 “(ii) The Secretary shall limit the requirement 6 for explanations under clause (i) to consultations 7 furnished in a State— 8 “(I) in which all legal barriers have been 9 addressed for enabling orders for life sustaining 10 treatment to constitute a set of medical orders 11 respected across all care settings; and 12 “(II) that has in effect a program for or- 13 ders for life sustaining treatment described in 14 clause (iii). 15 “(iii) A program for orders for life sustaining 16 treatment for a States described in this clause is a 17 program that— 18 “(I) ensures such orders are standardized 19 and uniquely identifiable throughout the State; 20 “(II) distributes or makes accessible such 21 orders to physicians and other health profes 22 sionals that (acting within the scope of the pro- 23 fessional’s authority under State law) may sign 24 orders for life sustaining treatment; 1 “(III) provides training for health care 2 professionals across the continuum of care 3 about the goals and use of orders for life sus- 4 taining treatment; and 5 “(IV) is guided by a coalition of stake- 6 holders includes representatives from emergency 7 medical services, emergency department physi 8 cians or nurses, state long-term care associa 9 tion, state medical association, state surveyors, 10 agency responsible for senior services, state de- 11 partment of health, state hospital association, 12 home health association, state bar association, 13 and state hospice association. 1 “(B) An advance care planning consultation with re- 2 spect to an individual may be conducted more frequently 3 than provided under paragraph (1) if there is a significant 4 change in the health condition of the individual, including 5 diagnosis of a chronic, progressive, life-limiting disease, a 6 life-threatening or terminal diagnosis or life-threatening 7 injury, or upon admission to a skilled nursing facility, a 8 long-term care facility (as defined by the Secretary), or 9 a hospice program. 10 “(4) A consultation under this subsection may in- 11 clude the formulation of an order regarding life sustaining 12 treatment or a similar order. 13 “(5)(A) For purposes of this section, the term ‘order 14 regarding life sustaining treatment’ means, with respect 15 to an individual, an actionable medical order relating to 16 the treatment of that individual that— 17 “(i) is signed and dated by a physician (as de- 18 fined in subsection (r)(1)) or another health care 19 professional (as specified by the Secretary and who 20 is acting within the scope of the professional’s au- 21 thority under State law in signing such an order, in- 22 cluding a nurse practitioner or physician assistant) 23 and is in a form that permits it to stay with the in- 24 dividual and be followed by health care professionals 25 and providers across the continuum of care;
1 “(ii) effectively communicates the individual’s 2 preferences regarding life sustaining treatment, in- 3 cluding an indication of the treatment and care de- 4 sired by the individual; 5 “(iii) is uniquely identifiable and standardized 6 within a given locality, region, or State (as identified 7 by the Secretary); and 8 “(iv) may incorporate any advance directive (as 9 defined in section 1866(f) (3)) if executed by the in- 10 dividual. 11 “(B) The level of treatment indicated under subpara 12 graph (A)(ii) may range from an indication for full treat- 13 ment to an indication to limit some or all or specified 14 interventions. Such indicated levels of treatment may in- 15 clude indications respecting, among other items— 16 “(i) the intensity of medical intervention if the 17 patient is pulse less, apneic, or has serious cardiac 18 or pulmonary problems; 19 “(ii) the individual’s desire regarding transfer 20 to a hospital or remaining at the current care set- 21 ting; 22 “(iii) the use of antibiotics; and 23 “(iv) the use of artificially administered nutri 24 tion and hydration.”.
Note that the ‘stakeholders’ will be the deciders here.

Savings, he writes, will require changing how doctors think about their patients: Doctors take the Hippocratic Oath too seriously, "as an imperative to do everything for the patient regardless of the cost or effects on others" (Journal of the American Medical Association, June 18, 2008).
Yes, that's what patients want their doctors to do. But Emanuel wants doctors to look beyond the needs of their patients and consider social justice, such as whether the money could be better spent on somebody else.
Many doctors are horrified by this notion; they'll tell you that a doctor's job is to achieve social justice one patient at a time.
Emanuel, however, believes that "communitarianism" should guide decisions on who gets care. He says medical care should be reserved for the non-disabled, not given to those "who are irreversibly prevented from being or becoming participating citizens . . . An obvious example is not guaranteeing health services to patients with dementia" (Hastings Center Report, Nov.-Dec. '96).
Translation: Don't give much care to a grandmother with Parkinson's or a child with cerebral palsy.
